道路旅客运输及客运站管理规定(征求意见稿)(446)

<P style="TEXT-INDENT: 32pt; MARGIN: 0cm 0cm 0pt; mso-pagination: widow-orphan; mso-char-indent-count: 2.0" class=MsoNormal><SPAN style="FONT-FAMILY: 仿宋; FONT-SIZE: 16pt">道路客运是综合运输体系中运输量最大、通达度最深、服务面最广的一种运输方式。长期以来,道路客运的快速发展有效满足了人民群众出行需求和社会经济发展需要,发挥了基础性、保障性作用。《客规》作为《中华人民共和国道路运输条例》(以下简称《道条》)的配套规章,为规范道路客运及客运站经营活动,落实经营者安全生产主体责任,维护道路客运市场秩序,保障旅客和经营者合法权益发挥了重要作用。近年来,随着机动车保有量高位增长、综合运输体系持续健全、移动互联网与运输服务融合发展加快推进,旅客出行需求、客运服务供给发生了深刻变化,结合道路客运发展新形势新要求,《客规》已存在一些不适应的地方。<SPAN lang=EN-US><o:p></o:p></SPAN></SPAN>
<P style="TEXT-INDENT: 32pt; MARGIN: 0cm 0cm 0pt; mso-pagination: widow-orphan; mso-char-indent-count: 2.0" class=MsoNormal><SPAN style="FONT-FAMILY: 仿宋; FONT-SIZE: 16pt">为此,交通运输部于<SPAN lang=EN-US>2018</SPAN>年启动了《客规》修订工作,在系统梳理了相关法律法规要求和目前道路客运行业管理存在问题的基础上,形成了修订草案。后续,多次开展专题研究、组织召开座谈会,赴辽宁、黑龙江、山东、广西、甘肃等地开展实地调研,听取地方管理部门、行业协会、道路客运相关经营者意见,完成形成修订征求意见稿。<SPAN lang=EN-US>2019</SPAN>年<SPAN lang=EN-US>6</SPAN>月,《客规》征求意见稿书面征求了各省级交通运输主管部门和中国道路运输协会意见,并就班车客运定制服务管理组织有关经营者专题听取意见。根据反馈意见进一步修改完善后,形成公开征求意见稿。<SPAN lang=EN-US><o:p></o:p></SPAN></SPAN>

<P style="TEXT-INDENT: 32pt; MARGIN: 0cm 0cm 0pt; mso-pagination: widow-orphan; mso-char-indent-count: 2.0" class=MsoNormal><SPAN style="FONT-FAMILY: 楷体; FONT-SIZE: 16pt">(一)坚持利企惠民。</SPAN><SPAN style="FONT-FAMILY: 仿宋; FONT-SIZE: 16pt">深入贯彻简政放权、放管结合、优化服务要求,充分发挥市场在配置道路运输资源中的决定性作用,更好发挥政府作用,强化事中事后监管,有效降低经营者制度性交易成本,在守住安全底线、满足基本服务要求的前提下,提升经营者自主权,激发市场活力,提升人民群众出行安全感、获得感。<SPAN lang=EN-US><o:p></o:p></SPAN></SPAN>
<P style="TEXT-INDENT: 32pt; MARGIN: 0cm 0cm 0pt; mso-pagination: widow-orphan; mso-char-indent-count: 2.0" class=MsoNormal><SPAN style="FONT-FAMILY: 楷体; FONT-SIZE: 16pt">(二)坚持统筹兼顾。</SPAN><SPAN style="FONT-FAMILY: 仿宋; FONT-SIZE: 16pt">修订中,注意处理好三个方面的关系:一是处理好《客规》与《道条》等法律法规的关系,确保《客规》修订的合法性以及与现行上位法规定的衔接性、统一性。二是统筹处理好道路客运传统模式与“互联网<SPAN lang=EN-US>+</SPAN>”新模式的关系,推动形成新老模式相互促进、双向互济的发展局面。三是统筹处理好改革发展和安全稳定的关系,确保道路客运行业改革稳中求进、行稳致远,切实维护行业安全稳定发展局面。<SPAN lang=EN-US><o:p></o:p></SPAN></SPAN>
