中国银保监会就《信托公司资金信托管理暂行办法（征求意见稿）》公开征求意见的通知(17)
<P style="TEXT-INDENT: 36.15pt; MARGIN: 0cm 0cm 0pt; mso-pagination: widow-orphan; mso-char-indent-count: 2.0; mso-layout-grid-align: none" class=MsoNormal><B><SPAN style="FONT-FAMILY: 仿宋; FONT-SIZE: 18pt; mso-bidi-font-family: 宋体">第十五条<SPAN lang=EN-US><SPAN style="mso-spacerun: yes"> </B><SPAN style="FONT-FAMILY: 仿宋; FONT-SIZE: 18pt; mso-bidi-font-family: 宋体; mso-bidi-font-weight: bold">信托公司开展固定收益类证券投资资金信托业务，经信托文件约定或者全体投资者书面同意，可以通过在公开市场上开展标准化债权类资产回购或者国务院银行业监督管理机构认可的其他方式融入资金，并应当符合以下规定：<SPAN lang=EN-US><o:p></o:p></P>

<P style="TEXT-INDENT: 36pt; MARGIN: 0cm 0cm 0pt; mso-pagination: widow-orphan; mso-char-indent-count: 2.0; mso-layout-grid-align: none" class=MsoNormal><SPAN style="FONT-FAMILY: 仿宋; FONT-SIZE: 18pt; mso-bidi-font-family: 宋体; mso-bidi-font-weight: bold">信托公司计算资金信托总资产时，应当按照穿透原则合并计算资金信托所投资的资产管理产品的总资产。<SPAN lang=EN-US><o:p></o:p></P>
<P style="TEXT-INDENT: 36pt; MARGIN: 0cm 0cm 0pt; mso-pagination: widow-orphan; mso-char-indent-count: 2.0; mso-layout-grid-align: none" class=MsoNormal><SPAN style="FONT-FAMILY: 仿宋; FONT-SIZE: 18pt; mso-bidi-font-family: 宋体; mso-bidi-font-weight: bold">信托公司开展固定收益类证券投资资金信托业务以外的其他资金信托业务，不得以信托财产对外提供担保，不得以卖出回购方式运用信托财产，不得融入或者变相融入资金，国务院银行业监督管理机构另有规定的除外。<SPAN lang=EN-US><o:p></o:p></P>
