论网络环境下的版权侵权与保护

【内容摘要】网络的自由与开放，使得传统版权受到了严重的挑战，网络版权的保护就显得由为重要。但我们在保护网络版权的同时，必须平衡与互联网发展之间的关系，既不能抑制互联网的发展，又要保护好作者的网络著作权。因此本文对网络环境下的侵权主体及侵权责任的认定，网络作品的合理使用制度、网络版权客体的认定和网络作品著作者的权利等方面加以论述，最后提出了网络环境下版权保护的建议，以此来阐述网络版权保护的必要性和限制性。

On Copyright Infringement and Protection in the Internet

Abstract
In the new digital times, traditional copyright is faced serious challenge with the development of Internet. Therefore, how to protect the copyright in the Internet is very important；but when we protect the online copyright，we must balance the relation between traditional copyright and online copyright.
The paper is designed to discuss the research on copyright infringement and protection in the Internet. Although the paper mainly discusses the protection of online copyright, it is not simply expand of author’s right under the network environment, but aims at the characteristic of online copyright, and makes reasonable system.
First, this part discusses subject and responsibility of the online copyright infringement. This part gives three subjects and studies how to confirm their infringement responsibilities.
