内容摘要设立中公司的根本目的是追求公司的成立，而在公司设立过程中，发起人必然要以设立中公司的名义进行一些与公司设立公司相关的必要民事活动。设立中公司在公司设立过程中招用劳动者，从事公司设立活动，是公司设立过程的客观需要。由于设立中公司不是用人单位，但它在公司设立过程中招用劳动者，从事设立公司设立的活动，所以，我们必须正确处理劳动者和设立中公司因设立中公司的用工行为发生的争议，以此保障劳动者的劳动权的实现，维护劳动力市场的稳定。

Abstract The basic purpose of establishment of company is established, and the pursuit of company established in the company, to set up in the initiators must, on behalf of the company and related companies to establish the company some necessary civil activities.
