[摘要] 国民待遇原则作为不歧视原则的一个重要方面，在自由贸易条件下，国民内部一律平等，不能因差别有所歧视。基于国民待遇原则，为充分保障农民权益，以国民待遇为基础的WTO法律体系不仅要求政府职能彻底转变，而且农民的利益应加强保护。中国加入以国民待遇为基础原则的WTO或许是一次机会，在推动保障农民权益方面，给农民兄弟一次历史机遇。

The Researching on the Peasants' Legal Rights

Abstract: the principle of the National Treatment, as an important aspect of the principle of the non-discrimination, under the free trade condition, all are equal and exist no discrimination. Basing on the principle of the National Treatment, to protect the peasants' legal rights, WTO that is base on the principle of the National Treatment both requires the government to transfer the administrative function and shall protect strongly the peasants' legal rights. China's accession to the WTO to be base on the principle of the National Treatment maybe is lucky for peasants to protect the peasants' legal rights.
