内容提要：《合同法》第44条第2款关于合同需经登记或批准才生效的规定，尽管最高人民法院对此作出了相关司法解释，新颁布实施的《物权法》对此进一步作出了明确规定。关于合同登记和批准的效力主要表现在二个方面：即登记或审批为合同生效要件；合同登记为对抗要件。绝大多数登记或审批对合同效力不产生任何影响，特别是合同登记制度应区别于物权登记制度。

The Impact of the Contract Registration and Approval on the Contract Effect from the Case

Abstract: "Contract Law" Article 44, paragraph 2 prescribed that contract must be registered or approved to take effect, although the Supreme People's Court have made the relevant judicial interpretations and the newly promulgated "property law" have made a further clearly defined. The effect of contract registration and approval performance in two major aspects: the registration or approval are elements of which the contract can take effect; contracts registered as the against elements.In the vast majority of cases the registration or approval do not have any influence on the contract. In particular, the contract registration system shall be separate from property rights registration system.
