历史总在重复上演。在对《鹿特丹规则》的热情消退之后,我们发现,公约的前景似乎并不乐观,其不能生效或不能迅速生效的后果似乎也没有多么可怕。实力决定规则,这是残酷的国际现实。就我国而言,我国尚不具备独立引领制定海运公约的实力,维持现状也许更符合我国的国家利益,“等待和观望”未尝不是一个明智的选择。
