企业内部劳动规则效力的探讨

摘 要:随着我国由计划经济时代向社会主义市场经济时代的转型再到社会主义市场经济的深化改革,企业内部劳动规则对企业的重要性日益彰显。企业有权力有义务制定企业内部劳动规则来约束劳动者在参加劳动过程中的行为,同时制定内部劳动规则时也往往要受到法律规范及职工的限制。自我国《劳动合同法》实施以来企业内部劳动规则与我国相关规则的冲突越来越明显,因此本文以企业内部劳动规则的效力为切入点来探讨企业内部劳动规则与相关规则冲突的解决之法。

To Investigate the Effectiveness of Internal Labor Rules

Abstract: With China from a planned economy to a socialist market economy,and then to the deepen reform of a socialist market economy,the importance of internal labor rules is increasingly highlight to enterprises. Enterprises have the power to develop internal labor rules to restrain the workers participating behavior in the process of labor, while the development of internal labor rules is often limited by legal norms and workers.Since the China's "Labor Contract Law" was implemented,the conflict of internal labor rules and external constraint mechanism are more and more obvious,so this paper expound the effectiveness of internal labor rules as a starting point to explore the way of resolve conflict of internal labor rules and rules .
