[摘要]
我国随着社会主义市场经济的建立，体制改革不断的深入，经济得到较为稳定和长足的发展。但是，近年来随着社会经济的转型和体制改革，极少数犯罪分子也乘隙而入，特别是具有黑社会性质的组织的犯罪活动的出现，严重侵害我国的政治、经济秩序，损害广大人民群众的合法权益，甚至人身安全。本文通过对“黑社会性质组织犯罪”的概念及其法律特征的阐述，并结合我国的实际情况，对如何打击和预防、治理黑社会性质的组织犯罪提出了建设性的意见和思考。

[ 英文摘要]
In recent years, our country economy has experienced a greater development than before as a result of the establishment of the socialist market economy. However, due to criminal activities perpetrated by certain individuals operating in the shadows of the underworld, our country's image has been tarnished. These activities have also detrimentally affected law abiding citizens with respect to their lives and personal estates. The article gives some insight into the prevention of crime in the underworld in its discussion of the conceptual basis of the underworld and its perception of law.

一、“黑社会性质的组织”的法律定义
"黑社会"一词，依据牛津大学出版社编、商务印书馆出版的牛津高阶英汉双解词典解释为英语Underworld（part of society that lives by vice and crime），意为"下流社会、黑社会"。
