论我国直销立法的若干法理问题
On Some Legal Issues of Direct sales Legislation in China

内容提要：直销是当今世界上最先进的商业销售模式，1990年进入中国。2005年《直销管理条例》、《禁止传销条例》出台。然而至今，中国的直销行业虽有发展，但仍在蹉跎岁月中前行。立法存在缺陷是制约直销行业发展的首要原因，本文针对两条例四个方面的法理缺陷作了深入浅出地分析，将对完善立法促进直销行业发展产生一定影响。

Abstract: Direct sales is the most advanced commercial sales model in the world today, which was introduced into China in 1990. The Direct sales Regulations and the Prohibition ofPyramid Regulations were promulgated in 2005. However, although China's direct sales industry has been developing, it is still moving forward in the years. The flaw of legislation is the primary reason for restricting the development of the direct sales industry. This paper makes an in-depth analysis of the legal defects of the above two regulations in four aspects, and would make a certain impact to promote the direct sales legislation.
