网购消费者个人信息权法律保护研究
[摘要]:电子商务飞速发展的今天,网络购物因其方便、快捷、省时的特点,突破时间和空间的限制,为大多数消费者所青睐,大有赶超传统购物方式的趋势。与此相对应,快速发展的网络消费模式必然会对消费者的保护提出更高的要求,也对国家或其法律制度解决网络消费中消费者个人信息保护问题的能力提出了严峻的挑战。随着电子商务的虚拟化和开放化的特征的不断强化,使得网络购物带给消费者购物时更大的不确定性和风险性。不少商家以次充好、雇佣刷好评、拒绝消费者给差评、故意泄露消费者个人信息等不良行为,成为网络购物纠纷的导火索。导致网络购物消费者的交易安全、知情权、公平交易权、个人隐私权等受到侵犯。而由于网络购物在我国兴起不久,我国对隐私权的保护较为滞后。网购发展势头虽猛,现行的法律却对其无法系统的规制。面对这样一个棘手的课题,我们不得不以国内当前零散的隐私权保护规定为研究起点,在浅薄的基础之上找寻网络消费者个人隐私权保护的依托。找到一个平衡点,以满足网购环境下各方利益的保护。

Research on the Right to Protect Personal Information of Online Shopping Consumers

Absrtact: With the rapid development of e-commerce, online shopping breaks through the limitation of time and space because of its convenient, fast and time-saving characteristics, and is favored by most consumers. It has a tendency to catch up with traditional shopping methods. Correspondingly, the rapid development of network consumption mode will inevitably put forward higher requirements for consumer protection, and also poses a severe challenge to the ability of the state or its legal system to solve the problem of consumer personal information protection in network consumption. With the enhancement of virtualization and openness of e-commerce, online shopping brings more uncertainty and risk to consumers. Many malpractices, such as suboptimal, employing good reviews, refusing consumers to give bad reviews, deliberately leaking consumers'personal information, have become the fuse of online shopping disputes. This leads to the infringement of the transaction security, the right to know, the right to fair trade and the right to personal privacy of online shopping consumers. However, due to the rise of online shopping in China soon, the protection of privacy in China lags behind. Although the development momentum of online shopping is rapid, the current law can not systematically regulate it. Faced with such a thorny issue, we have to start with the scattered privacy protection provisions in China, and find the support for the protection of personal privacy rights of online consumers on a shallow basis. Find a balance point to meet the protection of interests of all parties in the online shopping environment.
