240年前，意大利著名刑学家贝卡里亚出版了一本至今仍响彻刑法学界的著作《论犯罪与刑罚》，从而一场轰轰烈烈至今仍悬而未决的死刑存废之争由此爆发。这场持续百年之久的争论为我国这样一个死刑大国认清死刑的本质价值提供了一份良好的参考“资料”，而从这个价值深入，我们似乎可以清晰的看到死刑在我国现实不能废与未来的限制消亡命运。

Abstract
Before 240 years, famous punishment of Italy man Bei Kaliya published one still resounds through up to now the works of penal code educational circles " bys guiltys and penalty ", thus a up to now still outstanding death penalty on a grand and spectacular scale deposits uselessly it contends the eruption from this. That this goes on a hundred years argues seeing clearly for so big country of a death penalty of our country that the essential value of death penalty provided a good reference " material ", and from this value thoroughly, we seemingly can distinctly sees that the death penalty at our country reality can not give up with the confinement of future to wither away the destiny.
