【摘要】网络发展的日新月异，使得越来越多的交易在网上进行。近年来，电子商务的迅速发展受到了国际社会的普遍关注。电子合同是电子商务的基础与核心。它以其独特的订立方式对传统的纸面交易提出了法律、技术和监管等方面的挑战。电子合同中的法律问题阻碍了电子交易的进行，也制约了电子交易的发展。因此，我国应加快电子商务的立法工作，并完善电子合同交易的法律制度。

Abstract：Network’s advancement is changing with each passing day and increasing trade depend on network. In recent years, the rapid development of the electronic commerce is paid universally attention by international society. Electronic contract is the foundation and core of electronic commerce. With its particular way of being made, electronic contract challenges the transaction on paper terms of law, technology, supervision and so on. The legal issues in electronic contract have constrained the process and development of transaction. Therefore, it’s necessary for our country to acclerate the legal system of law making on electronic commerce and complete the legal system of electronic contract transaction.

随着网络经济的发展、信息时代的来临，Internet正以崭新的面貌给我们的生活带来全新的方式。它的到来不仅为人们提供了大量有用的信息，而且为人们的学习、工作和生活等方面带来了极大的便利。与此同时，人们的传统观念在信息时代里也受到了冲击和挑战，人们不得不以全新的思维去接受信息时代里的新事物。
