摘要：商业秘密是现代企业核心竞争力的重要组成部分，随着资讯产业的发展,对商业秘密的侵害越来越突出。本文基于现行立法，分析了商业秘密的构成要件，并针对实践中存在的高发的侵害企业商业秘密的行为提出企业应采取的相应的应对措施。在此基础上，本文分析了企业以法律手段保护其商业秘密的方式和应该采取的合理的步骤,并借鉴国外立法提出了从法律上赋予权利人妨害预防请求权的必要性。

Analysis of Law On The Protection of Enterprise’s Trade Secret

Abstract: Trade secret is one of the most important resources of the modern enterprise. With the development of the information industry, the damage to trade secret becoming more and more serious. This paper analysis the composed elements of trade secret form the viewpoint based on current law and gave some suggestion to deal with the commonly seen methods of damage to trade secret of enterprise. From all above all, this paper try to make up some helpful propositions to enterprise so that they can take proper law measures to protect their trade secret.
