略论立案监督的制度保障

摘要：本文针对我国立案监督制度在实践中面临的困境，提出了改革和重构立案监督保障机制的主张。作者首先分析了当前我国立案监督保障机制的现状及成因，指出其不足之处，并认为立法的缺失是造成这种情况的根本原因；接着作者提出了改革和重构的思路：对公安机关的立案监督保障，立法应明确建立四层相应制裁措施，对人民检察院自侦部门的立案监督保障在保留目前这种内部监督的前提下，创设检察审查会制度，实现监督目的。

Discussion on safeguards of supervision over placing cases on file

Abstract: Directing against the predicament of supervision over placing cases on file in practice, this article holds that its safeguards should be reformed and rebuild. At first, the author analyzes the safeguards of supervision over placing cases on file in our country now, points out its weakness, and thinks that legislation is the fundamental reason. Secondly, the author raises his thinking: to public security organization, legislation should establish sanctionative measures at four layers;to procuratorial organization, legislation should reserve the internal supervision, and create examinational committee to achieve supervision over placing cases on file.
