摘要: 任何人享受他人劳动而不付款都是不当得利和不公平。不动产留置权向建筑工人和供料人提供了一种有效的法律救济。但不动产留置索赔人应登记其留置权而不是占有不动产，如同不动产抵押那样，以利物尽其用。文章综述了美国不动产施工留置权的特点、程序、操作和规则，并阐述了美国的业主付款防卫制度和信托基金。为了解决工程拖欠款问题，我国物权法应设立不动产施工留置权。

Abstract: It is unjust enrichment and inequitable for everyone to enjoy another's work without paying for it. A lien on real estate provides a effective legal remedy for builders and materialmen. A lien claimant against real estate should register his lien but not possess the real estate, as such a mortgage on real estate to make the best use of everything. This article summarized the characteristics, the processes, the operations and the rules of the U.S. mechanic’s lien on real estate, And expounded the owner’s defense systems of payment and the trust funds in the U.S. In order to solve the construction debt question, our country reality of law should legislate the construction lien on real estate.
