摘要: 文章研究了美国工程担保制度。美国各州有施工留置权法律，以保证工人和供应商有优先受偿权。承包商必须提供合同保证担保给业主，包括一份100%合同价的履约担保，一份100%付款担保，附加一年保修期，但无须以其资产反担保给担保公司。担保人有责任为业主及承包商完成工程。美国这种制度值得我们借鉴。

Abstract: The article researched the construction bonds system of United States. There are the mechanic's lien laws in each states of U.S., to guarantee the workers and the suppliers having the priority. Contractor must provide a contract surety bond to the owner, including a 100% performance bond of contract amount, a 100% payment bond, plus a one-year maintenance period, But need not provide his assets pledged to the surety company. The surety has responsibilities to the owner and the contractor for project completion. This kind system in U.S. is worth our using for reference.
