内容摘要:把政府项目代建制引入到公路项目建设中,是我国工程建设的一个内在需要,也是一个发展趋势.我国的公路项目政府代建制仍处于起步阶段,还有一些问题有待讨论与确实. 本文将试从法律的角度谈谈对政府代建制在公路项目中的一些思考.

§0. 引言
我国政府投资项目在过去的近二十年里取得了飞速的发展,成绩与结果是有目共睹的.但是随着市场经济的不断发展,体制的老化,社会的进步,我国的政府投资项目普遍存在着一些问题,比如"三超"现象比较普遍，腐败事件发生比较频繁，投资效益往往不能最大化等等问题.由此在近些年来我国提出了“政府项目代建制”来克服这些问题.作为一种行之有效的政府项目建设制度,政府项目代建制已经在公路建设上开始试用并已经取得了一些成果, 有效的避免了职权犯罪与收益不能最大化的问题.
