Abstract
This article considers it is an inevitable history from the aliened plan under the Planned Economy System to the necessary planned regulation under the Market Economy System. And the above consideration is based on the correct understanding toward the value of plan. Under the premise, the article points out that market is the first time restriction to plan due to the inherent deficiency of plan, which means the plan regulation should not intervene when the economy is normally regulated by market force. Until the market malfunction rises up for the market deficiency and governmental adjustment should work, it is necessary for the law of plan to restrict the plan second time. And the legal relief and the legal responsibility are not only the indispensable element of the second time restriction, but also the weak part in the theory and practice of the plan law.
