关于保护旅游者的合法权益的若干法律问题

摘要：
今天，旅游业获得了空前的发展，然而人们在旅游的过程中常常会遇到一些不愉快的事情，极大的影响了人们的旅游兴致。此类不愉快的事情一经发生，轻则有伤心情，重则造成重大经济损失。作者认为本文要讨论的核心问题是：通过旅行社旅游的旅游者的合法权益被旅行社侵犯后，如何及时、合理、有效保护的问题。
根据社会发展的需要和法律的现状及旅游者合法权益的特殊性，我们建议在解决这个问题时贯彻三个基本原则：第一，强调旅游者知悉权原则；第二，旅行社虚假宣传责任和合同违约责任加重原则；第三，优先选择诉讼救济原则。通过上述三个基本原则的贯彻，以达到建立一个有效的社会和当事人本人对旅行社的监督体系。

Abstract:
Today, tourism industry has made unprecedented
development. In the course of tour, however, tourists
usually can meet some unsatisfied things, which lead
them to unhappiness or even great economic losses. The
author thinks that the critical problem, which will be
discussed in this article, is how to protect
tourists’ lawful rights and interests after infringed
by travel agency.
According to the request of the development of
society, under the present circumstances of law, and
particularity of tourists’ lawful rights and
interests, we suggest that when we resolve the
problems, we should carry out three basic principles,
