（四）应对协议管辖制度的限制运用作出更为全面、合理的规定
我国关于协议管辖不得违反我国级别管辖和专属管辖的限制规定过于简单和粗疏，不足以保证协议管辖制度在合理范围内得到适当运用。为此，应明确规定公共秩序保留制度的限制，适当引入不方便法院原则，体现和贯彻弱者利益保护原则。此外，对于管辖协议的订立手段和方式亦应有所要求和控制；当事人能否在协议法院获得有效的救济亦是衡量管辖协议效力的一个重要因素。

Abstract: The system of agreed jurisdiction has now become one of the basic jurisdiction system in international civil litigation, and obtains many new developments. The application of the system of agreed jurisdiction is necessarily limited in every country for the purpose of its reasonable application. To follow the international trend, the same system in our country should be bettered.
