专业课程的学习,也有助于职业技能的改进,受到学生与教师的广泛欢
迎。对我们非英语国家的学生和研究者来说,这样一套教材恰好是学
习、了解英语国家法学和提高法律英语水平的极好读物。
法律出版社作为中国最大的法律图书出版机构,一直致力于法律

丛书,受到佳评。如今,我们再次引进这套麦克米伦法学精要丛书,影
印出版,期冀在中文教材之外,为广大学子和研究人员进一步提供优秀
英文教材读物,谨献绵薄之力,给进步中的中国法治事业和进步中的中
国年轻一代。
这本由乔·肖编著的《欧盟法》(第三版)是一本为法学、政治学学生
提供的学习欧盟法的入门教科书。与同类的教科书相比,本书有以下
几个特点:
1.通俗、简明、视野开阔。欧盟法是一个自成一类的法律体系,突
破了传统的国际法与欧洲国内法的界限。要学习、研究好欧盟法,不但
要求具备国际法和欧洲国内法的知识和训练,还需对欧洲的政治、经
济、社会、文化等各方面有所了解,否则不易理解法律规则背后的东西
和规则产生的原因。在这一繁复的知识领域面前,本书作者没有故作
高深,而假定读者事先没有受过任何欧盟法的训练,从而以通俗的语言
介绍和解读欧盟法。同时,作者并未就条文谈条文,而将法律条文放到
更广阔的政治、经济、社会和文化大背景下进行分析。
2.资料翔实、精炼。从1951年欧洲煤钢共同体成252今,欧洲一
体化已经走过五十多年曲折、艰苦的历程。在这个过程中,学术界起到
了很大的推动作用,各种学术研究成果浩如烟海。本书在选取主要参
考书目与文章时,显然颇费心思——精心选择了大量1990年代以后优
秀学者的代表著述,并收录了部分1990年代以前这一领域不可不提的
经典,例如P.Pescatore在1983年发表的“TheDoctnneOf‘Direct Ef-
fect’:Anlnfant Disease in Community Law"。另外,欧盟法网上资源十
分丰富,本书许多章节都附有主要的查阅网址。
3.重点放在欧盟宪法和行政法。欧盟法基本可以分为三大部分:
宪法和行政法、经济法和对外关系法。本书主要研究和讨论的是欧盟
宪法和行政法方面的问题。作者假定该书的读者多数来自英国和其它
欧盟成员国,他们最关心的问题正是关系到欧盟成员国及其国民切身
利益的宪政问题。
值得一提的是,学习、研究欧盟法的一个困难是它的时效性较强。
夸张一点说,今天是法,明天一觉醒来就可能不再是法。这是由于欧洲
一体化本身的发展所致。学习、研究欧盟法应当在教材的基础上,十分
关注欧洲一体化本身的发展,经常更新自己的数据库。
